Terms of Service

1. Definitions

  • Platform — The AssureConcept software-as-a-service application accessible at assureconcept.ca.
  • User — Any natural person who registers for, accesses, or uses the Platform.
  • Firm — The legal entity (cabinet, corporation, or partnership) on whose behalf a User accesses the Platform under an organizational account.
  • Client Data — Financial, personal, and identifying information relating to the end-clients of a User or Firm that is uploaded to or generated within the Platform.
  • AssureConcept — AssureConcept Inc., a corporation incorporated under the laws of Quebec, Canada.

2. Purpose of the Service

The Platform is an analytical and productivity tool designed to assist financial professionals with document analysis, financial modelling, and report preparation. It does not constitute regulated financial, legal, tax, actuarial, insurance, or investment advice. Results produced by the Platform must be reviewed and validated by a qualified professional before being communicated to any client or third party.

3. Access and Account

Users are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account. Users must notify AssureConcept immediately upon becoming aware of any unauthorized use of their account. AssureConcept reserves the right to suspend or terminate any account that appears to have been compromised.

Access to the Platform requires registration and acceptance of these Terms. Access may be subject to a paid subscription as described on the pricing page.

4. Acceptable Use

Users agree not to:

  • Resell, sublicense, or otherwise transfer access to the Platform to unauthorized third parties;
  • Scrape, crawl, or systematically extract data from the Platform;
  • Attempt to gain unauthorized access to any part of the Platform or its underlying infrastructure;
  • Upload content that is illegal, defamatory, or infringes third-party intellectual property rights;
  • Use the Platform in a manner that violates applicable securities, insurance, or privacy regulation.

5. Data and Privacy

The collection, use, and protection of personal information is governed by our Privacy Policy, which forms part of these Terms. All data is stored on servers located in Canada and subject to Canadian privacy laws, including Law 25 (Quebec) and PIPEDA.

Users retain ownership of Client Data they upload to the Platform. By uploading Client Data, Users grant AssureConcept a limited licence to process that data solely for the purpose of delivering the Platform services.

6. Limitation of Liability

The Platform provides analytical simulations and projections for informational purposes only. Results may contain errors, omissions, or inaccuracies. AssureConcept and its affiliates disclaim all liability, to the fullest extent permitted by law, for any loss, damage, claim, or consequence arising from the use of Platform outputs without independent professional review, or from use of the Platform contrary to these Terms.

In no event shall AssureConcept's aggregate liability to a User exceed the subscription fees paid by that User in the twelve (12) months preceding the event giving rise to the claim.

7. Intellectual Property

All software, algorithms, user interfaces, and documentation comprising the Platform are the exclusive property of AssureConcept Inc. Nothing in these Terms transfers any intellectual property right to the User. Users may not copy, modify, reverse-engineer, or create derivative works from any part of the Platform.

8. Subscription and Billing

Subscription plans, pricing, and billing terms are described on the pricing page. Fees are non-refundable except as required by applicable law. AssureConcept reserves the right to modify pricing with thirty (30) days' prior notice to active subscribers.

9. Termination

Users may terminate their account at any time through the account settings page. AssureConcept may suspend or terminate access to the Platform immediately for breach of these Terms, non-payment of subscription fees, or for conduct that AssureConcept determines to be harmful to other users or to the integrity of the Platform. Upon termination, the User's right to access the Platform ceases immediately.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. The parties attorn to the exclusive jurisdiction of the courts of the Province of Quebec for the resolution of any dispute arising under these Terms.
